Terms of Service

Sparkwell is operated by Bossa Ventures LLC ("Bossa", "we", "us"), a limited liability company registered in the State of Wyoming, United States. Business address: 8200 NW 41st Street, 2nd Floor, Doral, FL 33166, United States. These terms are an agreement between you and Bossa Ventures LLC. By creating an account or purchasing a subscription you accept them.

1. The service

Sparkwell is consumer software for parents and caregivers, available as a web application at sparkwell.win, sold by subscription. It gives parents a daily plan, phrases and short family exercises. We do not provide consulting, medical, psychological or other professional services.

2. Eligibility and accounts

Sparkwell is for adults. You must be at least 18 years old and have legal capacity to purchase a subscription. The service is used by the parent or caregiver, not by the child. Keep your credentials confidential. Tell support@bossa-ventures.com if you think your account has been used without your permission.

3. Subscriptions and billing

Purchase. The price, billing period and features of each plan are shown before you pay. Prices are in United States dollars (USD) unless the checkout shows another currency for your region. Taxes are added where required.
Automatic renewal. Subscriptions renew automatically at the end of each billing period at the price shown at purchase, until you cancel. We will notify you in advance of any price change; you may cancel before it takes effect.
Introductory offers. When a welcome discount is shown, it is available for the time displayed on the offer. The price you subscribe at is the price you renew at.
Who bills you. Purchases are processed by Stripe. We do not store card numbers.
Statement descriptor. Charges appear as SPARKWELL.
Cancellation. You can cancel at any time in two taps inside the app (You → Cancel subscription), at sparkwell.win/account, or by emailing billing@bossa-ventures.com. Cancellation stops future renewals; access continues until the end of the period you have already paid for.
Refunds. See our Refund Policy: full refund within 30 days of a charge, no reason required.

4. Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Sparkwell for your own non-commercial purposes. You may not: copy, modify, reverse engineer or create derivative works of the software (except where the law permits); resell, sublicense, rent or share paid access outside your household; circumvent access controls, usage limits or payment mechanisms; use the service unlawfully or to transmit malware, spam or infringing content; scrape or place automated load on our systems without written permission.

5. Your content

You keep ownership of content you create or enter, such as quiz answers, check-ins and saved phrases. You grant us the limited licence needed to host, store, back up, transmit and display it so that we can operate the service for you.

6. Our intellectual property

The software, designs, characters, trademarks, brand names and site belong to Bossa Ventures LLC or its licensors.

7. Availability and changes

We work to keep the service available and release updates and improvements as part of it. We may add, change or discontinue features. If we discontinue a paid product altogether, we will give account holders reasonable notice by email and refund the unused part of any prepaid period.

8. Suspension and termination

You may stop using the service and delete your account at any time. We may suspend or end access if you materially breach these terms, if payment fails, or if the law requires. We give notice where practical and lawful.

9. Disclaimers

Sparkwell is provided "as is" and "as available". To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

Sparkwell offers general information and family routines for parents and is not medical or psychological advice. It does not diagnose, treat or cure ADHD or any other condition. Every child is different. Talk to your pediatrician, psychologist or another qualified professional about your child's health, development, behavior or medication. In an emergency, call 911 or your local emergency number.

10. Limitation of liability

To the extent permitted by law, Bossa Ventures LLC is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or data. Our total liability arising out of these terms is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or USD 50. Some jurisdictions do not allow these limits; where so, they apply only to the extent permitted.

11. Indemnity

You agree to indemnify Bossa Ventures LLC against claims, losses and reasonable costs arising from your unlawful use of the service or your breach of these terms.

12. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. The courts located in Sheridan County, Wyoming have exclusive jurisdiction, except where consumer protection law in your country of residence gives you the right to bring proceedings locally. Before formal proceedings, please contact legal@bossa-ventures.com so we can try to resolve the matter directly.

13. Changes to these terms

We will post changes on this page and update the effective date. Material changes are notified by email or in the product at least 30 days before they take effect.
